SpaceX AI Loses Bid to Dismiss NAACP Air Pollution Lawsuit
A federal judge rejected SpaceX AI's bid to dismiss a lawsuit from the NAACP over gas turbines used to power AI data centers near Memphis, according to CNBC. The case will proceed in the US District Court for the Northern District of Mississippi.
The NAACP filed the lawsuit in April 2026, through the Southern Environmental Law Center and Earthjustice, alleging that xAI and its subsidiary MZX Tech operated 27 gas turbines in Southaven, Mississippi, without an air permit between August and December 2025. The complaint says the turbines emitted pollutants and particulate matter in violation of the Clean Air Act.
SpaceX AI argued that the turbines were mobile sources exempt from permit requirements and challenged the NAACP's right to sue. The judge rejected those arguments: "Because the plaintiffs have statutory standing under the Clean Air Act, because the combustion turbines are not 'mobile sources' under Mississippi's SIP, and because the citizen suit provision does not violate Article II of the Constitution or the private nondelegation doctrine, the plaintiffs' claims will proceed." The same court rejected a Department of Justice request to end the case about two weeks earlier. SpaceX did not immediately respond to a request for comment, CNBC reported.
